There are no rights without limits, because exercising our personal liberties may harm others and encroach on their rights or those of the community. If an individual decides to fire a gun at a target in his suburban backyard, he may annoy, frighten, or harm his neighbors. Carrying a gun into an airport or college campus may intimidate, harm, or interfere with another person’s ability to travel safely or study in a safe environment. Living in a society with others means balancing rights.

America’s first Constitution, the Articles of Confederation (1778), required that each state maintain a well-regulated and disciplined militia in the event of a war.221 There was no official military force in the US until 1789. Michael Waldman, a constitutional lawyer with the Brennan Center for Justice, has argued that the framers of the current Constitution did not consider the rights of individuals to guns outside of militia service at all when they were drafting the Second Amendment. In his book, The Second Amendment: A Biography, Waldman wrote that the notes of James Madison and the other framers from the Constitutional Convention of 1787 did not mention private gun ownership, guns for self-defense, or guns for hunting.222
